Russia has a lower ranking of the number of patent applications filed by national applicants both in the country and abroad, the disparity in the rates of patenting activity by residents and non-residents suggest that there are systemic failures in patenting the results of intellectual activity, drug design in particular. Up to now, many issues of drug patenting have not been embodied in the current legislation. This situation is partly due to objective reasons. The decrease in the of development of Russian pharmaceutical industry, an insignificant number of lawsuits, the contradictory legal regulation or even its lack suggest that the above sphere of public relations is inconsistent with the current requirements. The paper considers the features and problems of the patenting of drug design in Russia and foreign countries.
